Man disgruntled over will went to solicitor's office with knife
A 57-years-old man who became aggrieved with the settlement he received in a will, went to his solicitor's office early one morning brandishing a kitchen knife and frightened the receptionist who was alone in the office at the time. At Galway District Court this week, Judge Mary Fahy sentenced Martin Noone, of Lakeview, Claregalway, to six months in prison for having a knife in his possession, contrary to Section 9 (1) of the Firearms and Offensive Weapons Act 1990, at Burke & Associates solicitors, Prospect Hill, Galway, on September 8, 2006. Inspector John Galvin said the accused went into the office at 9am and pointed a knife at the receptionist. He said that from reading the file of Noone's dealings with a solicitor in the office, he had come to the conclusion that Noone was aggrieved at the time over a settlement he received in a will. "There had been an ongoing problem with Noone in the office for some time and it appears that on the morning in question he took matters into his own hands. Due to stress he over reacted because he felt he was entitled to something that he wasn't entitled to and as a consequence he went into the office with the knife," the inspector explained. Defence solicitor Gearoid Geraghty said his client suffered from depression and epilepsy and had not taken his medication that morning for both conditions. He said that in Noone's own mind he felt aggrieved over the will and that coupled with his medical condition had led to him going to the office with the knife. Mr Geraghty said his client wanted to apologise to the receptionist who had always been very nice to him. He said Noone had no convictions for assault and this offence had been totally out of character. Judge Fahy said that, thankfully, there were not many such charges of people carrying knives in Galway and it was even more unusual to have someone actually produce a knife to another person. The judge wanted to know if the receptionist had been affected by the ordeal. Inspector Galvin said she had been terrified and very upset at first and could be called to court if the judge wanted to speak to her. Mr Geraghty admitted that his client had gone to the office very early - at 9am - and that the receptionist had been on her own at the time. Judge Fahy asked Noone why had he gone to the office so early. "I was very upset," he replied. Judge Fahy told him that Galway was blessed with numerous legal offices and if he had a grievance with one solicitor he could have changed to another solicitor. "Whether you had a genuine grievance or not you had no right to do this," Judge Fahy said to Noone. "I know that," he replied. Judge Fahy said Noone's behaviour was totally unacceptable. She said the receptionist must have been terrified knowing she was alone in the office so early in the morning. She imposed a sixmonth sentence and granted leave to appeal.
