Conviction for man who claims he was assaulted by bouncers
A 22-years-old Ballybane man who alleged he was beaten by bouncers when refused entry to a city night-club, was convicted of breaching the peace in relation to the same incident when he appeared before Galway District Court this week. Martin McDonagh, 9 Lios na Run, Ballybane, Galway, pleaded guilty to the offence and to being drunk in public on February 25 last outside Cuba night-club. Inspector Marie Skehill told the court that Gardai Derek Mullen received a call to go to the night-club at around 11pm where he found McDonagh being restrained by bouncers after he had become abusive towards them. The inspector said McDonagh was very intoxicated and aggressive at the time and he made allegations to the garda that he had been assaulted by the bouncers. That matter, she said, was still under investigation. Defence solicitor Noel Rhattigan said his client had been told by door staff not to bother waiting to be let in because he was too intoxicated. Mr Rhattigan said his client was was no more intoxicated than anyone else going to the door. "He was quite badly beaten up by door staff and his injuries were evident on the night," Mr Rhattigan alleged to Judge Mary Fahy. The solicitor said his client, who is unemployed, had attempted to make a complaint to Gardai that night but was told to wait, due to his intoxication, until the following day. The court heard McDonagh had never given a statement to Gardai, even though he claimed to have called to the Garda Station on two or three occasions afterwards but had kept missing Garda Mullen. Judge Fahy said McDonagh had dealt with the matter inappropriately. She observed that as he was unemployed he could have made a statement at the Garda Station at any time since last February. She convicted and fined him 300 for breaching the peace and took the charge of being drunk into account.
