Bring your toothbrush to court, man is warned
A Circuit Court Judge this week advised a Shantalla man to bring his toothbrush to court if he does not pay for damage he caused to a car parked near his home, adding that he would serve a four-month prison sentence imposed in the District Court, if full compensation was not paid by next July. Lawrence Burke (49), 42 Fursey Road, Shantalla, Galway, had pleaded guilty to causing 3,718 worth of damage to the new car, which was parked outside his neighbour's house, on February 22 last, when he appeared before Judge Mary Fahy in the District Court last July. She had sentenced Burke to four months in prison for the offence and he appealed the severity of that sentence to the Circuit Court this week. The District Court heard at the time that a number of eye witnesses saw Burke smash wing mirrors and scratch the car with his fists and with a stick. The car's owner had parked it outside his mother-in-law's house and gone away for a few days. At the time, Burke could not give any explanation for damaging the car. The appeal hearing in the Circuit Court this week heard that Burke had two previous convictions for being drunk in public and was under the influence of alcohol when this damage occurred. Judge Groarke was told Burke was in receipt of 207 in disability payments each week and that he had brought 350 to court to give to the car's owner. Burke gave the excuse that he had vented his frustration on the car after he tripped on the footpath beside it. Judge Raymond Groarke warned Burke that if he did not have the 3,718 in court next July he would affirm the District Court sentence. "If you were really sorry you would have more than 350 in court today. This happened last February and even though you got a sentence in July you still only brought 350 into court today. I doubt you are really remorseful," the judge said, adding, "Bring the entire 3,718 into court next July and if not, bring your toothbrush with you because you will be going away."
